These General Conditions of Purchase regulate the use of the website baterabrand.com (hereinafter "The Website"), owned by Batera Brand, SL (hereinafter Batera). Batera Brand, SL is a commercial corporation with registered office at Calle García de Paredes 78, 28010 Madrid, Spain, with Tax Identification Number (NIF) B42926709 and registered in the Mercantile Registry of Madrid, Volume 43717, Folio 195, Entry 2, Page M 771695. The customer's use of the online store services always implies acceptance of the General Conditions of Purchase in the version published at the time of the purchase order. Therefore, it is advisable for the customer to read these General Conditions before making a purchase.
1. Scope of the contract
These General Conditions of Purchase apply to the sale of all Batera items through its website. Batera reserves the right to cancel a customer's account if fraudulent, speculative, or malicious acts are detected in the use of this service.
2. Purchase limit
For security reasons, purchases exceeding €10,000 or with more than 50 items per order cannot be made.
3.- Purchase procedure
The items you wish to purchase must be selected and added to the shopping cart by clicking on the corresponding icon.
The shopping cart will contain the item reference number, name, size, color, and price in euros (tax included). The price does not include shipping, which will vary depending on the shipping method selected.
To complete a purchase, the customer's personal information will be required. This information will be added to Batera's database for processing. The personal information provided by customers will be processed in accordance with our Privacy Policy.
If the customer is a registered user, they will be able to access, at any time, the personal data provided and information on orders placed.
Before placing an order, the customer will be presented with a summary of the order, identifying the product(s) added to the shopping cart, their total price (including shipping and taxes), with a breakdown of each item, and the order's shipping details. The customer can confirm the order by clicking the "pay" button.
If an error is detected in the order before confirming payment, you can modify any of its details by clicking the "modify" button, or you can add or delete more products.
Once the order is placed, the order number will be communicated through the website so the customer can track it at any time from their device.
An automatic email will also be sent to the address provided by the customer to acknowledge receipt of the order, including a description of the order and any personal information provided.
Failure to receive this message may be due to a temporary network communications problem or a typing error in the email address provided, so we recommend that you contact hello@baterabrand.com .
Receipt of the aforementioned order acknowledgment does not constitute Batera's acceptance of the order. All orders are subject to the company's acceptance.
Batera is not obligated to accept the order and may, at its discretion, refuse to accept it. The customer, however, acknowledges that by clicking the "pay" button, they are obligated to pay for the product(s).
In this sense, the order is considered accepted when Batera notifies the customer via a new email confirming that the order has been shipped.
The contract between the customer and Batera regarding the product(s) ordered will be deemed finalized when the customer receives confirmation. The contract applies only to the products indicated in the confirmation. Batera will not be obligated to supply any product that has not been confirmed.
4. Price
The applicable prices are those indicated on the website at the date of the order. Prices are detailed for each item and include VAT (Value Added Tax), IGIC (General Indirect Tax of the Canary Islands), or IPSI (Tax on Production, Services, and Importation in Ceuta and Melilla), as applicable. The shipping costs are detailed for the customer when placing the order.
5. Payment
Payment will be made at the end of the purchasing process and is an essential condition for its completion. Under no circumstances may payment be made later. Deferred payment methods such as cash on delivery or bank transfer are not accepted. Accepted payment methods: Purchases can be paid for with Visa®, Mastercard®, Amex® credit cards, 4B or 4B Maestro debit cards, Apple Pay, Google Pay, PayPal, and Bizum. In all cases, the payment method is selected during the purchasing process on the corresponding screen.
The customer must notify Batera of any improper or fraudulent charges on the card used for purchases, by email or phone, as soon as possible so that the appropriate measures can be taken. Payment providers or issuers may adopt anti-fraud measures that result in the rejection of certain types of transactions. Batera is not responsible for the implementation of these types of security policies.
6. Delivery
The delivery period will be a maximum of 30 calendar days from the date of purchase. Orders will be delivered to the address indicated by the customer, subject to the following conditions:
5.1 Home delivery:
We ship nationally and internationally with no minimum order.
Domestic shipping within the Iberian Peninsula will be free if your purchase exceeds €75. Otherwise, shipping costs will be borne by the customer and will vary depending on the destination:

The address provided by the customer may be a home address, a workplace, or any other address provided. The billing and shipping addresses do not need to match. Our shipping provider will send an email or SMS (if you provided a mobile number in your order) indicating the delivery date and allowing the delivery date to be changed. On the scheduled delivery day, our shipping provider will send an email or SMS (if you provided a mobile number in your order) informing you of the approximate delivery time.
5.2 Delivery incidents:
If delivery cannot be made due to the recipient's absence, the shipping agency will leave a note and attempt to contact the recipient by phone. After two unsuccessful attempts, the customer must contact the shipping agency to process the delivery.
7. Changes, returns and withdrawal
There are different procedures for making exchanges, returns, and withdrawals (order cancellations). Below, we'll describe the characteristics of each, as well as their costs and conditions:
(1) Exchange : Exchange means the replacement of a garment with the same one in another color and/or size, provided that it is the same model.
(2) Return : when there is an error in the shipment (we send you a different garment than the one you ordered) or the product has a defect or factory defect.
(3) Withdrawal or cancellation of the order : when the customer decides, unilaterally, to cancel the order and return the product, without having to allege anything.
All products to be exchanged or returned must be properly packaged.
In the event of withdrawal, you will only be liable for any decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the goods.
7.1 CONDITIONS, REFUND AND PROCEDURE.
Conditions (Exchanges and Withdrawal): You have 14 calendar days from receipt of the product(s) to withdraw from the contract without providing a reason. We only exchange sizes or colors; if you exchange a model, you must return the product and place a new order with the new product.
Conditions (Returns): Batera will respond to any lack of conformity that becomes apparent within the period established by law.
Refund: Batera will refund the corresponding amount without undue delay and, in any case, within 14 calendar days from the date on which it was informed of the return. The refund will be made using the same payment method used for payment. However, we may withhold the refund until we have received the goods back or until you have provided proof of the return of the goods, whichever is met first.

8. Availability of products
If there are any supply issues or if products are out of stock, the customer will be informed immediately and the amount for the out-of-stock product(s) will be refunded. Batera will refund the corresponding amount without undue delay and, in any case, within 14 calendar days. The refund will be made using the same payment method used to make the payment.
9. Warranty of the purchased products
The guarantee offered is that established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users.
10. Customer Responsibilities
The client undertakes to make lawful use of the services, without violating current legislation or harming the rights and interests of third parties.
The client guarantees the truthfulness and accuracy of the data provided when completing the contract forms, avoiding any damage to the company resulting from incorrect information.
Failure to comply with any of the contracting conditions may result in the non-acceptance of an order and, consequently, the non-delivery of a product.

Batera's Customer Service will respond to your complaint as quickly as possible, and in any case within a maximum period of one month. If your request is not satisfactorily resolved, you may appeal to the ordinary courts or process your complaint through the website http://ec.europa.eu/odr, which will provide a free single point of access for out-of-court resolution.
12. Modification of the general purchasing conditions
Batera reserves the right to modify these General Conditions of Purchase at any time. No modification will affect orders already in progress.
13. Force majeure
Batera's performance of all or part of its obligations will be suspended in the event of a fortuitous event or force majeure that prevents or delays performance. Such events include, but are not limited to, war, riots, insurrection, social unrest, strikes of any kind, and supply problems not attributable to Batera.
Batera will inform the customer of any such unforeseen event or force majeure within seven days of its occurrence. If such suspension extends beyond fifteen days, the customer will have the option of canceling the current order and will be reimbursed under the conditions set forth in Section 6 of these General Terms and Conditions of Purchase.
14. Applicable law and jurisdiction
These General Conditions of Purchase are subject to Spanish law. Notwithstanding the foregoing, consumers not residing in Spain also enjoy the protection guaranteed by the mandatory provisions of the law of the country of their habitual residence. The parties submit, at their discretion, to the courts and tribunals of the customer's domicile for the resolution of disputes, waiving any other jurisdiction.
